We take our privacy obligations seriously and we've created this privacy policy to explain how we store, maintain, use and disclose personal information.
This Privacy Policy applies to users of the Quicka Health Platform and is incorporated by reference into our SaaS terms of service, which are accessible via hyperlink during sign-up. Our handling of personal information is governed by Australian privacy laws. Even if we are not required to comply with the Privacy Act 1988 (Cth) as a small business operator, we aim to handle personal information in a manner consistent with the Australian Privacy Principles. If you are located outside Australia (including in the EU/UK and/or the United States), additional privacy notices or jurisdiction-specific terms (such as a GDPR/UK GDPR addendum) may apply.
By providing personal information (including sensitive information) to us, you consent to our storage, maintenance, use and disclosing of personal information in accordance with this privacy policy.
We may change this privacy policy from time to time by posting an updated copy on our website and we encourage you to check our website regularly to ensure that you are aware of our most current privacy policy.

The personal information we collect may include the following:

How we collect information from you

- submit any of our online enquiry forms;
- communicate with us via email, telephone, SMS, social applications (such as LinkedIn or Facebook) or otherwise;
- interact with our website, social applications, services, content and advertising; and

How we collect information from third parties
Where possible, we collect your personal information directly from you. However, there may be occasions when we collect personal information (including sensitive information) about you from someone else. For example, where a clinic or business administrator creates an account for you, or where an authorised representative provides information on your behalf.
How you provide information for someone else
If you are providing personal and/or sensitive information on behalf of someone else (for example, where you are an authorised representative of a healthcare practice or you upload a patient's information to the Quicka Health Platform), you must have the consent and authority of that person to provide their personal and/or sensitive information to us to be collected, used, and disclosed in accordance with this privacy policy. We reserve the right to request evidence of this consent and authority.
If you are providing personal and/or sensitive information on behalf of someone under the age of 18 (Minor), you must have the authority and consent of the Minor's parent or legal guardian (or another lawful basis) for the Minor's personal and/or sensitive information to be collected, used and disclosed in accordance with this privacy policy.
How we collect information from cookies
We may also collect personal information from you when you use or access our website or our social media pages. This may be done through use of web analytics tools, "cookies" or other similar tracking technologies that allow us to track and analyse your website usage. Cookies are small files that store information on your computer, mobile phone or other device and enable and allow the creator of the cookie to identify when you visit different websites. If you do not wish information to be stored as a cookie, you can disable cookies in your web browser.
4. Use of Your Personal Information
We collect and use personal information for the following primary purposes:
- to provide goods, services or information to you;
- for record keeping and administrative purposes;
- to provide information about you to our contractors, employees, consultants, agents or other third parties for the purpose of providing goods or services to you;
- to improve and optimise our service offering and customer experience;
- to comply with our legal obligations, resolve disputes or enforce our agreements with third parties;
- to send you administrative messages, reminders, notices, updates, security alerts, and other information requested by you; and
- AI features: We use AI tools to deliver our services (for example, to transcribe audio and assist with generating notes, documents and treatment plans). By default, we use personal information (including any sensitive information in information uploaded to the Quicka Health Platform) only to provide our services to you and for related purposes described in this policy. We will not use identifiable personal information to train or develop general-purpose AI models unless you opt in.
- to consider an application of employment from you.
We may also use your personal information for:
- secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use;
- such purposes where we reasonably believe that use of your personal information is necessary to lessen or prevent a serious threat to the life, health or safety of any individual, or to public health or safety, and it is unreasonable or impracticable to obtain your consent;
- any other purpose for which we receive consent from you; or
- any other purpose which is permitted or required under applicable privacy laws.
5. How We Disclose Your Personal Information
We respect your privacy, and we will take reasonable steps to keep your personal information confidential and protected. We may disclose your personal information to:
- our contractors and service providers (such as cloud hosting and database providers (including Supabase and Vercel), AI model and transcription service providers (including Google Vertex AI), audio processing providers (including Fly.io), payment processors (including Stripe) and analytics providers (including Google Analytics, Meta (Facebook) Pixel and Vercel Analytics));
- our professional advisors such as lawyers, accountants and auditors;
- our related entities; or
- any third parties you have consented personal information to be disclosed to.
We may also disclose personal information to third party contractors as required for us to provide our goods and services to you, such as cloud-service providers, IT professionals, marketing agencies and debt collection agencies.
We take care to work with such third parties who we believe maintain an acceptable standard of data security and require them not to use your personal information for any purpose except for those activities we have asked them to perform on our behalf.
We will not otherwise disclose your personal information unless:
- you have consented to us disclosing your personal information for particular circumstances;
- as needed in an emergency or in investigation of suspected criminal activity;
- we are required to disclose under a subpoena, court order or other mandatory reporting requirements;
- we reasonably believe that disclosure of your information is necessary to lessen or prevent a serious threat to the life, health or safety of any individual, or to public health or safety, and it is unreasonable or impracticable to obtain your consent;

6. Storage of Your Personal Information
We strictly store and process all personal information (including health information) on secure servers located within Australia. We configure our services to ensure that personal and clinical data never leaves Australian jurisdictions. Our current cloud infrastructure and processing providers include Supabase, Vercel, Google Vertex AI, and Fly.io. All core patient data, databases, and automated backups are hosted entirely within Australia. We do not transfer, process, or store personal or health information on overseas servers.
We utilize Google Vertex AI for clinical intelligence, strictly routed through Australian endpoints. This service is contractually configured for onshore processing with a strict zero-data-retention policy. Consultation audio is processed using models running on dedicated, isolated infrastructure located in Sydney, Australia, ensuring voice data is never transmitted to offshore third-party providers.
We take all reasonable steps to ensure our Australian-based subprocessors handle personal information in a manner that strictly aligns with this privacy policy, the Australian Privacy Principles (APPs), and our enterprise security commitments.
We may use analytics and advertising tools on our marketing website, including Google Analytics, Meta (Facebook) Pixel and Vercel Analytics. Google Analytics and Meta Pixel use cookies to collect anonymised usage and advertising data. Vercel Analytics and Vercel Speed Insights are cookie-free and do not collect personal data. Our clinical application uses essential cookies only for authentication and session management.
When you communicate with us through a social media service such as Facebook or Twitter, the social media provider and its partners may collect and hold your personal information overseas.
7. Sensitive Information
Collection of sensitive information
We may collect sensitive information (including health information) during the course of providing our goods and services. This can include health information contained in consultation audio recordings, transcripts, clinical notes and treatment plans uploaded to the Quicka Health Platform. We will only collect this sensitive information where you consent to such collection, where you are authorised to provide it (for example, you have obtained any required patient consent), or otherwise in accordance with the law.
Types of sensitive information we collect
The sensitive information we collect may include the following:
- health information, history and reports;
- consultation audio recordings, transcripts, clinical notes, treatment plans and related documents uploaded to the Quicka Health Platform;
- any other health information contained in information uploaded to the Quicka Health Platform by you (or on your behalf); and
- any other sensitive information provided by you or a third party to us via our website or platforms, or otherwise provided by you or a third party to us.
How we use your sensitive information
Your sensitive information will only be used for the purpose of:
- providing you with our goods and services;
- complying with our legal obligations, resolving disputes or enforcing our agreements with you;
- sending you messages, reminders, notices, updates, security alerts, and other information requested by you; or
- any other purpose which is permitted or required under applicable privacy laws.
How we disclose your sensitive information
Your sensitive information will only be disclosed to third parties for the purpose of:
- providing you with the Quicka Health Platform and related support services;
- enabling you and your authorised users to access and use the Quicka Health Platform;
- engaging our contractors and service providers (such as cloud hosting providers and IT professionals) to help us operate and support the Quicka Health Platform;
- complying with our legal obligations, including responding to lawful requests and preventing or reducing a serious threat to life, health or safety; or
- any other purpose which is permitted or required under applicable privacy laws.
How you can withdraw consent
If you wish to withdraw your consent to our collection, use or disclosure of your sensitive information, please contact us using the contact details set out below. We will deal with all such requests within a reasonable timeframe.
8. Marketing
We may at times send you marketing communications which will be done in accordance with the Spam Act 2003 (Cth) (Spam Act).
If we do, we may use email, SMS, social media, phone or mail to send you direct marketing communications.
Where consent is needed, we will ask you for your consent before sending you marketing communications, except where you:
- have explicitly opted-in to receiving email marketing from us in the past; or
- were given the option to opt-out of email marketing when you initially signed up for one of our platforms and you did not do so.
You can, at any time, opt out of receiving marketing materials from us by using the opt-out facility provided (e.g., an unsubscribe link on emails we send you) or by contacting us via the details provided at the end of this privacy policy. We will implement such a request as soon as possible, however, cannot guarantee that such a response will be immediate.
We will not use sensitive information (such as health information) for direct marketing purposes without your explicit consent, and we do not sell personal information to other companies for marketing.
9. De-Identified Information
The information we collect may have analytical, educational, or commercial value to us. We may convert personal information we collect into data that does not identify an individual (de-identified data). We may use and share de-identified, aggregated information for analytics, security, quality improvement and to improve the Quicka Health Platform and our services. We will not release de-identified written documentation derived from your information in a way that could reasonably re-identify any individual without your consent.
10. Security
We take reasonable steps to ensure your personal information is secure and protected from misuse or unauthorised access. Our information technology systems are password protected, and we use a range of administrative and technical measures to protect these systems. However, we cannot guarantee the security of your personal information.
In the event of a data breach involving personal information, we will take reasonable steps to investigate and respond. If the breach is an eligible data breach under the Notifiable Data Breaches scheme in the Privacy Act 1988 (Cth), we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.

Our website may contain links to other websites. Those links are provided for convenience and may not remain current or be maintained. We are not responsible for the privacy practices of those linked websites and we suggest you review the privacy policies of those websites before using them.

We may need to verify your identity before providing you with your personal information. In some cases, we may be unable to provide you with access to all your personal information and where this occurs, we will explain why.
