1. Acceptance of Terms
By accessing or using Quicka Health ("the Service"), operated by AKW Ventures Pty Ltd t/a Quicka Health ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
2. Service Description
Quicka Health provides a clinical documentation and workflow support platform for healthcare professionals. The Service includes consultation recording, transcription, structured note drafts, treatment-plan handout workflows, calendar synchronisation, and related tools.
Important: Quicka Health is a documentation and workflow support tool. It is not intended to diagnose, screen, monitor, predict, recommend investigations, recommend treatment, or replace professional judgement. Clinicians must review and approve all outputs before use.
3. Eligibility
The Service is intended for use by registered healthcare professionals and their authorised staff. By creating an account, you represent that you are a qualified healthcare practitioner or are authorised by one to use the Service.
4. User Obligations
When using the Service, you agree to:
- Provide accurate and complete registration information
- Maintain the confidentiality of your account credentials
- Review and verify all drafted content before use in clinical practice
- Comply with all applicable healthcare regulations and professional standards
- Obtain appropriate patient consent for the use of recording and AI documentation tools
- Not share your account with unauthorised individuals
- Not use the Service for any unlawful purpose
5. Intellectual Property
The Service, including its software, design, and documentation, is owned by AKW Ventures Pty Ltd t/a Quicka Health and protected by intellectual property laws. You retain ownership of all clinical content you create using the Service.
6. Data & Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.
7. Fees & Payment
The Service is offered on a subscription basis. Current pricing is available on our Pricing page. We may change our fees upon 30 days' notice. Refunds are handled in accordance with Australian Consumer Law.
8. Limitation of Liability
To the maximum extent permitted by law, Quicka Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:
- Errors or inaccuracies in drafted content
- Service interruptions or data loss
- Clinical decisions made using the Service
Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding the accuracy of drafted content, fitness for a particular purpose, or uninterrupted availability.
10. Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be available for export for 30 days.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland, Australia.
